•When we purchased the house, Angus went through the sale process with us. We signed on Weds afternoon and he explained that the vendors would sign the next day, Thursday, and he would email us the signed contract which would mean that the cooling off period would last until Monday, 2 full business days, with the weekend in between. He emailed us the contract next day, however he did not mention to us that he had changed our agreement by going to see the vendors on Weds evening getting them to sign the contract early, hence the cooling off period would end on Friday. I had to insist that he reverted to our original agreement. Not long after that we received an email request to rate him, but to rate him for selling us a completely different property! We had quite a long settlement time but after about 4 weeks I phoned him and left a message asking if it was possible for us to go to the property and meet the vendors to get an idea of the complexities of the water supply (the house has bore, rainwater and mains). He phoned back and told me he was sorry but the house I was interested in had been sold – I had to remind him that I was the purchaser. When we finally moved in, we found that both the major items included in the sale were flawed to the extent that had we known, we would have insisted they be removed. The large wall-mounted plasma TV was not actually a TV at all, just a display unit, with the interface box, a critical component, missing. The previous owners had it working solely via Foxtel – we do not want Foxtel and therefore it is completely useless. The fridge works but all the controls are broken, so temperature cannot be changed nor can we use any of the features. I do not know what the agent's responsibility is here, but the agent we sold through insisted on full and open disclosure, which we think is admirable.
