Property Other Than As Advertised – Agent Unconcerned, refusing to represent situation to the Vendor

Property, (serviced land only), advertised as for the lucky buyer - provides lucky purchaser a block featuring all services available ... "With services available, jump on this option to acquire today and build in time..." But instead, we purchased a block on which a major infestation of problematic weeds had been caused and hidden; the weeds being such that any normal activity on the block would encourage further spread of the weeds, and deny any sensible work on-site for a year or more, until the weeds could hopefully be eradicated as much as possible. The potential for germination of weed seeds persisting in the landscape, would remain and require careful inspection, vigilance and removal, for years to come. Having paid a price recognising the 28% increase in UCV over the previous year, it is particularly galling that we now have to pay for the application, and potential re-applications, of herbicides over a significant area, and also suffer the delay and associated costs for an extended uncertain period. The Vendor, or person(s) known to the Vendor, must have been aware of the problem weedy trees, as removal the few examples was attempted, hiding their previous existence, only to later result in an infestation over an extended area.
