Sadly I bought into the smooth sales pitch Emma gave me and chose her over another agent. Emma & Freedom will likely try and invalidate my complaint, saying I was unhappy with the result or something similar. I can say hand on heart that this is simply based on facts and the unprofessional conduct of Freedom & Emma. 1) Freedom prepared a contract of sale and had the prospective purchasers sign it, before forwarding it to me to sign. The contract had a grave error in that it provided for a deposit of 20%. EVERY real estate agent KNOWS that the deposit MUST NOT exceed 10% otherwise the law automatically converts the regular sale agreement into an “instalment contract” (under s71 of the Property Law Act 1974) and the parties’ rights are VERY different eg buyers can pay just 1/3 of the sale price and then require the property to be transferred to them! It is inexcusable that this mistake was ever made. Had I signed the contract, I’d have potentially been ruined. They brushed the error aside when I raised it. I even emailed Freedom’s CEO given the seriousness of the error to suggest staff retraining was warranted. He never even bothered to reply. 2) Emma admitted that she ignored my clear instructions re negotiations “because she does this every day”. I had instructed her to go back to the buyers with a counteroffer but in the form of a contract already signed by me to show I was genuine. She ignored my instructions and just called the buyers. They said it sounded like I was “playing games” so they pulled out of negotiations. Had Emma given them my signed contract as instructed, they would have known I was genuine. (It doesn’t mean they would have accepted my counteroffer, but my point is that they wouldn’t have walked away because I was “playing games”). 3) When I expressed my dissatisfaction with Emma, she refused to accept any criticism and “dumped” me onto her colleague, Morgan, who actually sold the house (she did the after purchase video with the buyer 🙄).

We knew straight away that Emma and her team were the prefect agents to sale our home. Emma was proactive from the start with a great open and honest commination style. She helped us navigate this tricky and stressful process with ease. We could not believe how hard her whole team worked to get our home sold with in the first week. I felt like Emma actually listened to what I was looking for and knew her properties well. She would get back to me, even in her own time and sh was always really friendly and approachable. She actually went out of her way to make the whole process an exciting experience for me and the whole family so it didn't feel transactional.
