Seller and agent failed to uphold basic obligations

Our experience with Nic was frustrating and unnecessarily stressful. When genuine concerns were raised including several safety, functionality, and contractual compliance issues, his sellers consistently refused to take reasonable steps to address them. Despite these items being clearly documented in the building and pest reports, and well within the scope of the ‘working order’ clause in our contract, we were repeatedly met with resistance or deflection. Nic made little effort to help resolve these concerns. Settlement had already been delayed and yet Nic refused to return to the property to remove items that were required to be cleared prior to handover. He simply stated he had already been there that morning and wouldn’t be going back, despite knowing those items were still there and that their removal was a condition of handover. We were spending hundreds of thousands of dollars on this property, and now we’re required to spend more money to fix things that should have been addressed by the sellers before settlement. This could have easily been avoided had Nic and his sellers abided by the contract and acted like decent people. If it weren’t for our incredible buyer’s agent advocating for us every step of the way, I genuinely believe we would’ve been taken for a ride. What should have been an exciting milestone was made unnecessarily difficult due to a lack of professionalism and an unwillingness to support both sides of the transaction. Based on this experience, we would not recommend working with Nic.

Hi Ruth, I want to start by saying how deeply sorry I am that your experience in buying your new home felt the way it did and you left feeling frustrated & disappointed. I want you to know I was always trying to do what I could to keep things progressing as smoothly as possible, even though many of the hurdles were outside of my control. I pushed very hard behind the scenes to get items resolved & cooperation from the other side, but unfortunately, I was not always met with the same willingness. We had attempted to get items actioned from the moment they were identified, unfortunately, the quotes I arranged were not accepted. I personally attended the property multiple times the last week & rectified multiple items. The issues came with some electrical items, when we couldn't seem to get our electrician authorised to attend the property. I even offered to pay for the electrical work out of my own pocket. We did manage to get an electrician in & items rectified for you however this should have been done a week prior. If it was in my control it would have. I kept your buyers agent informed throughout the process so he knew where we stood with these items each day. This is what he sent me after sighting the review; "Hi Nic, I can only imagine how disheartening that must feel, especially considering the effort you put in. From my side, I truly believe you did all you could, recoding the garage door, offering your own trades, and even physically attending the property multiple times. That goes above and beyond what most would have done." That said, I completely understand how that doesn’t change how things felt on your end. When you’re buying a home, you should feel like the process is handled with care and a sense of partnership & I fell short of delivering that for you, even if unintentionally. I know I may not be able to change your initial experience, but I’m always open to feedback and committed to improving wherever I can.
