Purchased a property that Phil was the agent for.

We bought a property that Phil was was the agent for. In the beginning we quite liked Phil and trusted him. As first home buyers we followed the advice given by our conveyancers and B&P inspectors, being our first purchase we were slightly apprehensive and trusted those we had hired. In my experience with Phil he seemed more geared towards protecting the sellers than us. I wondered if he was friends with the sellers as they engaged him to sell for them on a property that was 40 minutes drive from his office. We had numerous time during the purchase that he didn’t answer emails to us. On settling day we turned up at the time set by the sellers (10am) to do our inspection and by 11am their removalist had not turned up meaning they still had all their belongings packed into the house. Settlement was due in an hour (12pm) so we contacted our conveyancers and they said the property should be vacant before settling and to should push back settlement by an hour or 2 so we could inspect the property when empty. We did that (even though the sellers claimed they would be out by the time settlement was due 12pm). We went to a local park to wait. The sellers were not actually out of the house until 3pm. At around 2.30pm Phil called us and threatened that if we didn’t settle then the sellers would put all their furniture back in the house and delay for two weeks. I contacted our conveyancers and they contacted the sellers solicitor and they said they had no idea why the real estate agent was threatening us with cancelling the contract as the sellers were not actually out of the house yet and were understanding of the fact we wanted the see the property empty of their belongings. In the end the sale went through at 3.30pm. All through we acted on our conveyancer’s advice. As first home buyers we would have liked an agent who understood our needs. We got an agent who made what should have been a happy day, into a stressful day that left us unhappy with the seller and agent.

Shane, you are obviously a first home buyer, Real Estate Agents don't control settlements, Conveyancers/Solicitors do and a Vendor is entitled to stay in THEIR home until it settles, AS THEY ARE THE LEGAL OWNER UNTIL THEN. Also, me relaying information from the Vendor is not a threat, merely a indication of what would be occurring if settlement didn't take place on that day. Every email was responded to, as were your dozens of texts and phone calls that you made and yes I do work for the Vendor, maintaining a happy medium for all parties during the settlement period. Anyway hope all goes well for you both in the future.
