This sale went through smoothly except for a contamination clause included within the contact, which was unknown to the listing agent, the vendor solicitors and apparently to the vendor themselves!! With such lack of knowledge of the sale conditions of the property by these three parties (to allow such an inclusion in the contract), and further resistance from the local council authority upon its discovery, one wonders whether there was some form of collusion in order to hide or disguise this fact from the purchaser? Fortunately, the clause resulted in no material change or danger to the purchased property, however a clear misunderstanding of the content of the sale contract was evident from all the parties to the contract.
