Do Not Trust This Agent

Tracie advised us not to sell our property until we had somewhere to go, so we signed a contract subject to the sale of our property. We put our property on the market straight away and it took 3 1/2 weeks to sell with great conditions. Tracie convinced us to let her add a sunset clause to her contract and assured us it wouldn't get 'bitten' by the clause. All along she told us that the seller was very pleased that we were purchasing the property and Tracie knew we were only selling our property to purchase. However on the same day we signed a contract on our property , Tracie told us that her seller was accepting another contract, which was for no more money but what she claimed were better conditions. Therefore invoking the sunset clause. Needless to say we were gutted. We were obviously stupid to have trusted anything Tracie said. When I tried to message her (more than once) to find out if the pressure pump at the rear of the house was working, I got no answer from her.

As advised before entering the contract, in any sunset clause scenario, it’s essential to be fully prepared: complete Building & Pest promptly; have finance ready if the clause is invoked so that you can then make the property unconditional and alleviate any undue stress; and notify your agent immediately before you execute the contract to sell your own property. Timing is everything, and these steps help strengthen the seller’s confidence in a subject-to-sale contract. Under Queensland legislation and REIQ requirements, I have a legal obligation to present all offers to the seller and the seller has the right to act on any offer that best suits their circumstances, including through the activation of a sunset clause. Throughout the process, I acted professionally, transparently and in line with these obligations. I’m glad you were supported by the network of professionals I connected you with for your Buyer journey. They were contacted immediately to assist you and were amazing. The pump was / is in working order. Had our once pleasant communication continued, I would have graciously communicated that to you. However, respect needs to be reciprocated at all times, even in the face of unpredictable professional uncertainty. I wish you and Bruce many happy years in your new home. It's a beautiful home in a sought-after neighbourhood and I am aware that many deserving prospective buyers tried their best to secure it. Best wishes. Tracie Robinson
