In this transaction, the contract was unconditional from the outset, as the cooling-off period was waived at signing. There was no later point at which the contract changed status.
A pre-settlement inspection was requested while the vendor was still residing at the property, which initially limited access. Once approval was granted, inspections were facilitated, including an additional inspection arranged to assist. I personally attended the property to provide access on each occasion. While the buyer did not attend these inspections personally, a representative attended on their behalf each time.
After concerns were raised, these matters were managed through the respective solicitors, which is the standard process once a contract is unconditional. A settlement extension was formally requested by the buyer’s solicitor and was agreed to and granted by both parties’ solicitors, providing additional time prior to completion. Any further requests regarding extensions or compensation are governed by the contract and handled by the legal representatives.
I understand that settlement periods can be challenging, and I regret that the buyer felt dissatisfied with the outcome. Throughout the process, I acted in good faith to facilitate communication, access, and settlement within the scope of my role and legal responsibilities.
