Within only days of applying for the property, we were notified of our successful application. Sam , our property manager was quick to get started for us to move in. We recently rented a property with Harcourts. Unfortunately, we were not happy with the property provided by them. The property was full of cockroaches. We noticed this issue when we were asked to do a condition report of the property. We did not move into the property until it was fumigated and cleaned properly. Evenafter, 3 times fumigation and cleaning , the cockroaches were still present. We decided to terminate the lease because we did not want to live in a uninhabitable property. The Harcourts agents informed us that if we decide to terminate the agreetment we would have to pay the rent until they find a new tenant. We paid them 1 month rent of $1400 and bond of $1400 for a property full of cockroaches and where we never moved into. We sent the photos and videos of the condition to the agents but they say that it is a livable house. Only because we signed the agreement with them , do they have the rights to take our money as rent?? We have all the evidence with us and planning to move legally, so that we get our money back which we paid for rent and bond. We believe that this is a breach of Section 36J and The Residential Tenancy Act 1997.
