Statutory Breaches, Liability Risks, and a Total Lack of Professionalism

I strongly caution any seller against engaging Audrey Xu or Harcourts Inner East. It took Audrey 3 months to sell my South Brisbane property in this hot market in Brisbane. Despite the delay, I acted in good faith and agreed to an early release of her commission before settlement to support her during personal circumstances she described as difficult. This goodwill was met with a complete disregard for my legal rights and privacy. On settlement day, Audrey committed two separate unauthorized entries into my residence, as confirmed by CCTV. First, she spent 2 hours cleaning—a task I had explicitly and repeatedly declined in writing. I explained multiple times that my only contractual obligation was to provide the property in a "broom clean" standard, vacant and free of rubbish. As a licensed agent, she should know these standard legal terms; it is not my responsibility to educate her on her own profession. By choosing to validate a meritless buyer demand over my lawful instructions, she committed a direct breach of Section 22 of the Property Occupations Regulation 2014. Most alarmingly, Audrey brought her two teenage children onto the premises to perform this unauthorized work. This created massive liability risks for me under the Occupiers' Liability Act (QLD). Had an injury occurred to the minors or the tap was kept running, my residential insurance could have been voided because the access was for a purpose not permitted under Clause 8.2 of the REIQ contract. Audrey even returned a second time with her children later solely for her own professional marketing purposes—another trespass for her own benefit. I am seeking a partial refund of the commission with all the documented evidence of these breaches and the severe liability exposure, I strongly urge other sellers to avoid an agent who ignores the law and violates your privacy.

RECORD PRICE achieved for a South Brisbane apartment, with smooth, ON-TIME settlement. I appreciate the opportunity to clarify, as this review presents an inaccurate account of events. The property was professionally marketed and negotiated, achieving a record price for comparable properties within the complex. Settlement proceeded successfully and in accordance with the agreed contract. All commission remained in our trust account until settlement, fully compliant with regulatory requirements and office policy. The early release of the deposit occurred strictly under the contract and at your request. At no time did I seek early release of my commission. Under the standard REIQ contract, liability transfers to the buyer shortly after the contract date, and the buyer is contractually entitled to delay settlement in accordance with the agreement. Following the pre-settlement inspection, the buyer raised last-minute concerns and indicated settlement may be delayed unless the property was addressed. As no cleaning was arranged, I attended at my own time and cost to ensure settlement proceeded on schedule. This resulted in no financial loss, damage, or disadvantage to you. For clarity, the second access referenced occurred after settlement, once ownership had transferred. Throughout the campaign, I also arranged complimentary extended staging and, at your request during negotiations, organised and covered the cost of temporary furniture hire for you to use until settlement to accommodate the buyer’s short finance extension and ensure the transaction remained intact. I stand by the result achieved and the professional service delivered. My priority in every campaign is to protect my client’s position, ensure compliance, and secure a successful settlement outcome.
