John sold our Parents house in Greystanes. there were no problems dealing with the whole family he arranges to meet them and answered all their question, with John it was easy, due to his calm nature and excellent communication during the meeting. John is an excellent realtor who works hard for us to achieve the best possible outcome and keep us updated at all times. Typical Agent…Concerned only about his commission and will tell buyers and sellers what ever to get the sale. I negotiated the sale price based on a short settlement. We signed a cover letter stating a 4 week settlement but John advised he could not legally change the front page of the contract to reflect 4 weeks. John advised me that my solicitor can change the front page during the cooling off period. The cooling off period is in place for the buyer, and during this time the seller can’t alter the contract conditions. It was even more disappointing to find out during this time John was telling the buyer via sms that the contract allows them a further 2 weeks for settlement but neglected to advise penalties also would apply. The sms from John was provided to me by the buyers solicitor. The buyer used Johns sms to argue a 4 week settlement was never agreed upon. During settlement because John did not change the front page settlement time and advised the buyer they could settle in 6 weeks in writing, it prevented me from claiming penalties from a delayed settlement costing me approximately $5K My solicitor instructed John to release the sale funds from the trust account and withhold $5K from the agreed commission due to his incorrect handling of the sale. John took the full commission amount and did not want to take any responsibility for his actions. I am in the process of taking John to Fair Trading for his actions. I will update the review once the Fair Trading hearing is complete.
